The elements of a Validated Contract - Essay Example A proposal is an act when a person wants to do something or abstain from and shares this thought or idea to someone, thinking or wanting that particular person to act or think in the same way. An offer is a promise that bounds a person keeping in mind that all the terms and conditions are disclosed and accepted as well. It means that there must be acceptance of exactly what has been offered as a proposal. This is the first step towards making a contract. Such a proposal or offer when accepted, it becomes a â€Å"promise†. All these actions are based on the intention to make a legal relationship. Generally, there is not any intension to make a legal relationship in daily routine agreements. However, for a valid contract, the agreement or acceptance must be on legal bases. A person who made an offer can withdraw the offer that has been made before it is accepted. To make the withdrawal successful, the person who has proposed the offer, should converse with the other party and in form them in clear terms that the offer has been withdrawn, and it doesn’t exists anymore. Similarly the acceptance must be made and communicated to the offerer. ... An agreement without consideration is considered to be void. Consideration stands as the cause or reason of the promise. Consideration is an essential part of a contract. Consideration is also termed as â€Å"object†. The object must be lawful for agreement to be called as contract. As long as consideration exists, the law does not question about its fairness and capacity. Without this, an agreement is not acceptable or it is not treated as a valid contract. The consideration should not be illegal or impossible to perform by any of the two parties involved. A consideration is unlawful if it is forbidden by law, fraudulent and the courts declared it as immoral act. A promise is always made in return of a promise. That promise must be ethical and lawful. 3. Legal Capacity: There are some restrictions regarding entrance into a valid contract. It is necessary for both the parties of the contract to be completely able to respond to the contract. Both parties must be proficient of e ntering the contract and in case they are not able to handle the contract, then the agreement will not lead to a valid contract. Each party must be fully aware of all the rules and restrictions. Also it should be experienced enough to deal with the contract. In terms of law, a party should be of â€Å"age of majority† and â€Å"sound mind†. These words clearly mean that parties must be mature enough for the contract. There are mentioned some groups of people which involve a problematic consent and are dealt in a separate way under specifies rules for them. The Affect of Child Labor on the World Introduction Child labor is a very hot topic in today’s world. The problems associated with child labor have always been a part of life but thanks to Globalization, everyone is now more aware of the child labor issues that exist. Whether an individual is in favor or against child labor the fact is that child labor affects everyone, because child labor affects the global economy. Children who work play a big role in the economy because they produce goods and are paid wages just like adults; they are an active participant of the work force. Child Labor Issues It is estimated that more than 200 million children across the globe between the ages of 5-17 work instead of going to school. And of these, 171 million work in hazardous conditions. Even though child labor was widespread during the eighteenth century it was not until the industrial revolution that society began to realize the seriousness of abuses on children that worked. In the past children generally worked alongside their families to help the family survive, but those conditions were not as severe as when children began working more than ten-hour days in factories and in adverse conditions like those seen during the industrial revolution. There are many other factors that cause child labor such as poverty, social values and cultural circumstances but they tend to be complex to understand. It can be said that child labor is more widely seen in developing and third world countries than that of developed. This is due in part to the poverty that the majority of these people liv e in, and then children are forced to work to help support the family. Asia has the highest number of children below the age of 15 that work wi... ...y with child labor. Conclusion Forturnatly, many organizations and individuals feel very strongly about protecting children and are trying to develop solutions to many of the problems associated with child labor and also to help protect the rights of children in the work place and in general. The International Labor Organization is an agency that is trying to develop a strategy to help prevent children form loosing their childhood and education by being forced to work. The American Era Historical Background * The Filipino revolutionists won against the Spaniards who colonized us for more than 300 years. * The Fil-American war resulted in the defeat of Gen. Miguel Malvar in 1903. * The American Rule was influenced by two factors: 1. ) EDUCATION- many were given a chance to study and English was used as the medium of instruction. 2. WRITERS- went through stages of development to acquire enough proficiency in the new language – imitative of the style and the subject matters of the American and European authors * Filipino writers went into all forms of literature like news, reporting, poetry, stories, plays, essays, novels, etc. Their writings clearly depicted their love of country and their longings for independence. * Imitation soon faded, writers began to turn to: native ideas and circumstances- inspiration for their writings.Movement Against the U. S. Colonialism * the printing press was used to block the American culture from entering the P hilippine lifestyle * Newspapers in our different dialects flourished all over the archipelago. * *Writers were given the chance to show and prove the true talent of the Filipinos * *Writers during these period drew ideas from the Propaganda Movement and the Revolutionary Characteristics of Literature During American Regime Three groups of writers contributed to Philippine Literature during this period. * Literature in Spanish The inspiration of Filipino writers in Spanish was Rizal. * Rizal’s two novels (Noli and Fili) contained the best qualities of a novel ever written, in English or in Filipino. * Those who were inspired to write in praise of Rizal were Cecilio Apostol, Fernando Ma. They were: * Poet of the Heart (Makata ng Puso) * Poets of Life (Makata ng Buhay) * Poets of the Stage (Makata ng Tanghalan) * Literature in English We can trace the beginnings of Philippine literature in English with the coming of the Americans thus, this period is divided into three time frames, namely: * The Period of Re-orientation: 1898-1910 * By 1900, English came to be used as a medium of instruction in the public schools. From the American forces were recruited the first teachers of English. * By 1908, the primary and intermediate grades were using English. It was also about this time when UP, the forerunner in the use of English in higher education, was founded. Writers of this period were still adjusting to the newfound freedom after the paralyzing effect of repression of thought and speech under the Spanish regime. * The Period of Imitation: 1910-1925 * By 1919, the UP College Folio published the literary compositions of the first Filipino writers in English. They were the pioneers of in short story writing. * They were then groping their way into imitating American and British models which resulted in a stilted, artificial and unnatural style, lacking vitality and spontaneity. * Writers of this folio included Fernando Maramag, Juan F. Salazar, Jose M.Hernandez, Vicente del Fierro and Francisco Tonogbanua. * The Period of Self-Discovery: 1925-1941 * By this time, Filipino writers had acquired the mastery of English writing. * They now confidently and competently wrote on a lot of subjects although the old-time favorites of love and youth persisted. * They went into all for ms of writings like the novel and the drama. Other Forms of Literature * Ilocano Literature * Pedro Bukaneg: Father of Ilocano Literature. His name was derived from the word Bukaneg meaning Balagtasan. * Claro Caluya: Prince of Ilocano Poets. Known as poet and novelist. Leon Pichay: known as the best Bukanegero (from Bukaneg). Also a poet, novelist, short story writer, dramatist and essayist. * Literature of the Kapampangans (Pampango Literature) * Juan Crisostomo Soto: (Father of Kapampangan Literature). The word CRISOTAN (meaning Balagtasan) in Tagalog is taken from his name. * Aurelio Tolentino: He truly proved his being a Kapampangan in his translation of KAHAPON, NGAYON AT BUKAS into Kapampangan which he called NAPON, NGENI AT BUKAS. * Visayan Literature * Eribert Gumban: (Father of Visayan Literature) He wrote a zarzuela, a moro-moro and a play in Visayan. Magdalena Jalandoni: She devoted her talent to the novel. She wrote ANG MGA TUNUK SAN ISA CA BULACLAC. LITERARY GENRES POE TRY * Written in 3 languges (Filipino, Spanish, English and in the different dialects) * Some known poets were: Maximo KalawPaz Marquez Benitez Carlos P. The Man I Killed in The Things They Carried Much can be interpreted by what people write. The great thing about interpretations is that different writings can be interpreted differently. Just like in the writings by Tim OBrien. His book titled The Things They Carried, is a very deep and touching collection of stories about the Vietnam War. The book is written, as a whole under the title The Things They Carried, but is a collection of many people’s experiences in this destructive war. One story that is a touching and very intriguing is titled, The Man I Killed. If anyone knows anything about Vietnam it is that many lives where lost in this disastrous war. Then OBrien goes on to talk of maybe why this young man was in the army, and maybe why he was fighting; these are something’s that are taught in the schools. OBrien states that the man may have joined because he was struggling for independence, juts like all the people that were fighting with him. Maybe this man had been taught from the beginning that to defend the land was a mans highest duty and privilege. Then on the other hand maybe he was not a good fighter, and maybe in poor health but had been told to fight and could not ask any questions. These reasons are all reasons that are taught in textbooks; they go along with the idea of the draft. Some people go fight because they want to and others go because they are told they have to. How do you tell these people apart in the heat of battle or when they are dead? The way that OBrien starts to describe the young man as someone who was small and frail, and maybe had plans for a bright future puts sorrow in the readers heart, in that all his plans can not happen for him or maybe the family that is longing for his return. It also shows the regret that maybe going on in the killers’ mind. For OBrien to be writing on how this you ng mans life has come to a sudden end and his plans for the future is over is intriguing. Then to add to that he had the story written through the eyes of the soldier that ended this young mans life.
